Refund policy

Fees are refundable only when we cannot act for you for compliance reasons, and only for work we haven't yet done. Please read this before you order.

Last updated 6 October 2026

1. Who this applies to

This policy applies to every fee paid to Nevis Formation ("we", "us") for formation, nominee, bank introduction, certificate, search and annual services ordered through this website or under an engagement letter. It forms part of our terms of engagement.

2. When we give a refund

We refund a fee only when we, our registered agent partner or the Nevis authorities cannot proceed for compliance reasons, for example:

  • you, a beneficial owner or another person in the structure doesn't meet our client acceptance policy;
  • know-your-client or source-of-funds checks can't be completed to the required standard;
  • a sanctions, PEP or adverse-media screening result means we can't act;
  • the registered agent or the Nevis Registrar refuses the application on compliance grounds;

A refund is only available for work that hasn't started or been completed. Once a company, trust or foundation has been registered, or a certificate or search has been issued, the fee for that service is earned and isn't refundable.

3. What we deduct

Where a refund is due, we return the fee less:

  • a compliance review fee of US$150 for each person we screened, covering the due-diligence work already done;
  • Nevis government fees already paid on your behalf;
  • third-party costs already incurred, such as apostilles, courier or certified copies;
  • bank or card charges for sending the refund.

4. What is never refundable

  • A change of mind, or a decision not to proceed, after you've paid.
  • Delays you cause, including documents not provided within 90 days of your order. After 90 days we treat the order as abandoned.
  • Bank account introductions. The fee covers preparing and submitting the application, and is not refundable if a bank or EMI declines the account. Approval is always at the institution's discretion.
  • Annual renewal and administration fees once the renewal period has started.
  • Company searches and certificates of good standing once ordered from the Registrar.
  • Government penalties for late renewal or late filings.

5. How to request a refund

Email bviformation@proton.me within 30 days of our notice that we can't proceed, with the subject "Refund request" and your order reference (for example NV-LLC-XXXXXX). We'll confirm the amount and the deductions in writing.

6. How refunds are paid

Approved refunds are paid in US dollars to the original payment method, normally within 14 business days of our confirmation. We can't send refunds to a third party or to a different account.

7. Card disputes

Please contact us before raising a dispute or chargeback with your card issuer. Most questions can be resolved quickly by email, and a dispute delays any refund that may be due.

8. Changes

We may update this policy. The version in force on the date you paid applies to your order.
