The Nevis International Exempt Trust Formation

A trust under the Nevis International Exempt Trust Ordinance, 1994, one of the most protective trust statutes in the world. It's built for families who want to protect wealth and decide, in writing, how it passes on, with their own private trust company as trustee.

Your family's own trustee: a private trust company

Every Nevis trust needs at least one qualifying trustee. Rather than handing your family's assets to a commercial trust company, you can form a private trust company (PTC): a Nevis company whose only role is to act as trustee of your family's trusts.

  1. i.

    Formed as a Nevis company

A Nevis IBC or LLC, incorporated for the sole purpose of acting as trustee.

  2. ii.

    Run by people you choose

Its board can include family members, trusted advisers and independent directors, so decisions stay with people who know the family.

  3. iii.

    Owned for continuity

The PTC's shares are often held by a Multiform Foundation, so control passes smoothly from one generation to the next.

  4. iv.

    No trust licence required

A PTC that acts only for one family, and doesn't offer trust services to the public for reward, qualifies as trustee without a licence.

The essentials

A trust separates legal ownership from benefit. The Nevis statute strengthens that separation against foreign creditors.

The parties

A qualifying Nevis trustee, such as your own private trust company
Protector
Optional; may veto decisions or replace the trustee

Creditor protection

Protection and succession

A Nevis trust does two jobs. It shields assets from future claims and settles who inherits them, outside any single country's probate process.

i.

Criminal standard of proof

A creditor must prove fraudulent intent beyond reasonable doubt, a far higher bar than the civil standard in most countries.

ii.

Foreign judgments not recognised

A judgment obtained abroad has no automatic effect. The creditor must start again before the Nevis High Court.

iii.

Protector

An independent protector can remove trustees and consent to key decisions, so control stays balanced without resting with the settlor.

iv.

Flight clause

The trust may move its governing law and administration to another jurisdiction if circumstances require it.

v.

Spendthrift provisions

A beneficiary's interest can't be assigned or seized by their own creditors before a distribution is made.

vi.

Pairs with a Nevis LLC

The trust owns the LLC and you manage the LLC day to day. Protection and practical control are combined.

Typical settlors

  • Families with assets in several countries and heirs in others
  • Business owners separating personal wealth from operating risk
  • Professionals exposed to liability over a long career
  • Settlors from civil-law countries seeking forced-heirship planning
  • Anyone combining asset protection with a clear succession plan

Nevis trusts, answered

What is a private trust company?

A Nevis company, usually an IBC or LLC, formed only to act as trustee of one family's trusts. Its board is made up of family members and advisers you choose. Because it doesn't offer trust services to the public for reward, it can act as trustee without a trust licence.

Can I be a beneficiary of my own Nevis trust?

Yes. Nevis law allows the settlor to be a beneficiary. For the strongest protection, distributions should be at the trustee's discretion, not the settlor's.

Why pair a Nevis trust with a Nevis LLC?

The trust owns the LLC and you act as its manager, so you run the investments day to day. If a threat arises, the trustee can replace you as manager, and both statutes' protections then apply.

Does a Nevis trust avoid US tax?

No. A trust with a US settlor is usually a grantor trust, so its income is taxed to the settlor. It's reported on Forms 3520 and 3520-A. The benefit is protection and succession, not tax.

How long does a Nevis trust take to establish?

Usually five to ten business days after due diligence, depending on how bespoke the deed is.
